Assists County Counsel in providing all civil legal services required by the County, its officers and boards.

Essential Duties and Responsibilities

The following are not all inclusive and other duties may be assigned.

01 Attends Board of Commissioners meetings as required by County Counsel and advises on such issues of law that may arise.

02 Assists County Counsel in representing or arranging representation of Klamath County and Klamath County employees in any legal action brought against them in the performance of their duties.

03 Assists County Counsel in drafting, examining or approving as to form all ordinances and any other documents having legal effect which are to be enacted or approved by the Board of County Commissioners; helps maintain codified ordinances of the County.

04 Assists County Counsel in providing or arranging for legal representation to the County in tort claim actions brought against the County under the Oregon Tort Claims Act; appears on County's behalf in State and Federal tort and civil rights actions filed against the County or participates with the Risk Manager in referring to insurance carriers for defense.

05 Assists County Counsel in performing such legal services as may be necessary in the enforcement of laws protecting County road right-of-way; reviews contracts; drafts forms and monitors local improvement district proceedings and performs such services as necessary in the enforcement of the assessment liens; takes such measures, as necessary, for the involuntary acquisition of real property for road purposes.

06 Assists County Counsel in representing County's land use interests at LUBA, Court of Appeals, and Supreme Court; provides legal analysis and opinion, as requested, to Planning staff; prosecutes violations of County land use codes; defends County's position in mandamus, statutory partition proceedings, and other suits commenced in the Circuit Court relating to the application of State and County land use laws.

07 Assists County Counsel in interpreting legal and contract issues as they relate to labor relations.

08 Assists County Counsel in providing advice, direction and opinions to Department Heads and Elected Officials regarding legal issues involving County policy.

09 Assists County Counsel in handling the legal matters involving County foreclosed properties.

10 Assists County Counsel in reviewing draft legal documentation for all Klamath County nuisance abatement violations and dog control violations; represents the County in these actions, when necessary in the local court, and during the appeal process.

11 Assists County Counsel in reviewing all special district formation, annexation and withdrawal matters as well as other special projects and assignments as directed by the Board of County Commissioners.

Education and/or Experience

Graduation from an accredited school of law; three years experience in the practice of law preferred or equivalent combination of education and experience.

01 Member in good standing of Oregon State Bar

02 Oregon Driver's License

Work Schedule

The normal work schedule is 8.00 hours per day 5 days per week; exact schedules are assigned by management. It is the attendance standard of the employer that all employees be present and on time each shift they are scheduled to work. Full or partial absence during any scheduled shift, arriving late, or leaving early, for whatever reason, may result in disciplinary action up to and including termination of employment. Time off may be approved if allowed by applicable policies covering illness, injury, or other personal emergency.
